Trio gets  bail for transporting liquor in a Govt vehicle during Lockdown

Bangalore ; The Police have arrested three persons in connection with transportation and hoarding of liquor during the lockdown period and has released them on bail at the Police station level.
The accused has been arrested as Bhaskar, Soma and Govind Reddy. The trio have been arrested in connection with trapping a person Vishesh Gupta, a businessman.
Accordingly Bhaskar has been booked for helping Vishesh to procure liquor and Govind Reddy for illegally stocking the liquor, While Soma, a bar tender has been booked for tampering the evidence.
There were more than 100 bottles of liquor in eight boxes when Police officer Vasu Reddy had seized a government vehicle a jeep in which the liquor was being transported. The accused have stated that these bottles were meant to be supplied to various liquor shops.
Interestingly, despite the Union Government directions to prosecute people under Indian Penal Code and Disaster Management Act 2005 incase they violate the lockdown rules; no action has been taken against the accused.
According to the legal experts this has been a clear violations of the lockdown rules issued by the Union Home Secretary Ajay Bhalia, who in an order dated 24 March, 2020 says, “Any person violating these containment measures will be liable to be proceeded against as per the provisions of Section 51 to 60 of the Disaster Management Act, 2005, besides legal action under Section 188 of the IPC".It is requested that for the attention of the public authorities and citizens, the penal provisions under the DM Act and IPC should be widely circulated and for violation of lockdown measures, action under relevant provisions shall be taken by the law enforcement authorities, he said. It has also been clarified that any kind of such violations will invite a jail term upto two years.
When contacted Bhaskar, one of the accused in the case refused to comment upon it.  It could be recalled that a couple of months ago Vasu Reddy, ACP Electronic City sub division was suspended in connection with a bribery case. The complainant Vishesh had stated that he was forced to pay bribery as the Police which seized the car housed him in a cell without booking or producing to the court. He was forced to sell his mother’s jewellery to bribe the Police officer.
